Agreement to Terms
By downloading, installing, or using any product or service provided by Obscura Labs, LLC ("Obscura Labs", "we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our software or services.
About Obscura Labs, LLC
Obscura Labs, LLC is a limited liability company organized under the laws of the State of Ohio. These Terms of Service govern your use of Obscura Vault and any other software, applications, or services we provide (collectively, the "Services").
Software Provided "As Is"
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OBSCURA LABS, LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the Services will be uninterrupted, error-free, or free of viruses or other harmful components
- Warranties regarding the accuracy, reliability, or completeness of any content or output
- Warranties that defects will be corrected
You use the Services entirely at your own risk.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBSCURA LABS, LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SERVICES, INCLUDING BUT NOT LIMITED TO:
- Data loss of any kind, including encrypted files, recovery phrases, or any content processed through our software
- Unauthorized access to your device, accounts, or data by third parties (hacks, breaches, or exploits)
- Loss of access to your data resulting from a forgotten PIN, lost recovery phrase, or device failure
- Any interruption or cessation of the Services
- Any bugs, viruses, or other harmful code transmitted through the Services by third parties
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if Obscura Labs, LLC has been advised of the possibility of such damages.
User Responsibility
You are solely responsible for:
- Safeguarding your recovery phrase. We cannot recover it. If it is lost, access to your encrypted data cannot be restored.
- Maintaining secure access to your device and accounts
- Any use of the Services that violates applicable laws or regulations
- Regular backups of any data you wish to preserve independently of the Services
Zero-Knowledge Architecture
Our Services are designed so that Obscura Labs, LLC has no access to your data, encryption keys, or recovery credentials. This architecture is a feature, not a limitation. As a consequence, we are technically incapable of restoring lost data or credentials on your behalf. By using our Services, you acknowledge and accept this design.
Indemnification
You agree to indemnify, defend, and hold harmless Obscura Labs, LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your use of the Services or your violation of these Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles.
Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised effective date. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
