Devices known as Stingrays (or IMSI catchers) impersonate cell towers, forcing every phone in the area to connect to them. This captures your location, your device identity, and data from innocent bystanders nearby — no warrant required. Over 75 agencies across 27 states are known to possess them. ICE has been documented using them in deportation operations, and law enforcement has actively worked to hide their use from courts and the public.

Geofence Warrants

Police can compel Google and other tech companies to hand over data on every device in a geographic area during a given time window — no specific suspect needed. The EFF has taken this practice to the Supreme Court, arguing it is the digital equivalent of the general warrants the Fourth Amendment was written to prevent.

The PATRIOT Act

Passed in the weeks after 9/11 with minimal Congressional debate, the PATRIOT Act granted sweeping surveillance powers that remain in effect today:

• Section 215 — Authorized bulk collection of Americans' phone records by the NSA without a warrant or individualized suspicion. Exposed by Edward Snowden in 2013.
• Section 206 — Roving wiretaps allowing surveillance across any device a person uses under a single order.
• Section 213 — "Sneak and peek" searches of your home or property with delayed — sometimes indefinite — notification.
• Section 505 — National Security Letters allowing the FBI to demand records from businesses without any court approval, with gag orders preventing disclosure.
